It is reasonable to say that the foundations of the Polish state are formed by the principles of independence and sovereignty as well as the supreme power of the nation. They are the essence of a sovereign state. The state performs its duties using the system of sources of law adopted in the Constitution, for which Art. 8 sec. 1. It states that the Constitution is the supreme law of the Republic of Poland. This norm obliges the state to enact and apply legal acts in accordance with the provisions of the Constitution, so the state’s policy serving the fulfillment of its obligations is subordinated to the Basic Law. This aspect is of particular importance from the point of view of Poland’s membership in the European Union. The regulation of the supremacy of the constitution in the Polish constitution is a formal guarantee of the stability of the Polish system and serves to protect the goals and functions of the state defined by Polish statehood. This also applies to the relationship with European Union law.
