This paper concerns the draft Article 64a of the Penal Code which constitutes an extraordinary aggravation of penalty for offenders who again commit a crime against sexual liberty and decency. It is a new type of return to crime. The amendment will contribute to a far-reaching intensification of sanctions against this group of criminals. Despite the obligatory aggravation per Article 64a of the Penal Code, the court will not always have to impose a penalty within the limits of this provision, as Article 57 § 2 of the Penal Code prevents it.
