PL

Rozwój miast uwarunkowany jest między innymi możliwoscią pozyskiwania gruntów na potrzeby realizacji celów publicznych. W miarę możliwości cele te są realizowane na gruntach Skarbu Państwa lub jednostek samorządu terytorialnego. Polski system prawny w wyjatkowych sytuacjach, po spełnieniu warunków brzegowych umożliwia stosowanie procedury wywłaszczeniowej. W niniejszym opracowaniu skoncentrowano sie na zagadnieniach realizacji procedury wywłaszczania nieruchomości w Polsce po 2004 roku. Wskazano na podstawowe elementy tej procedury, oraz dokonano analizy pojecia celów publicznych oraz słusznego odszkodowania. W pracy zawarto teżodniesienia do realizacji wywłaszczania nieruchomości w innych krajach poprzez szczegółowa analize tej procedury oraz porównanie jej z systemem obowiązujacym w Polsce. Na zakonczenie podano propozycje zmian w przepisach prawa dotyczących wywłaszczenia nieruchomości.

Urban development depends, among other things, on the possibility to obtain land for public purposes. Whenever possible, those purposes are achieved on the land that belongs to the State Treasury or local government units. In exceptional circumstances, the Polish legal system allows the application of the expropriation procedure, after certain boundary conditions have been met. This study focuses on the issue of carrying out the procedure of expropriation of a real property in Poland after 2004. It presents basic elements of this procedure, as well as the analysis of the terms of "public purposes: and "just compensation". Additionally, the study contains references to the expropriation of a real property in other countries by providing a detailed analysis of this procedure and comparing it with the system applicable in Poland. Finally, it presents certain suggestions concerning changes to legal regulations concerning the expropriation of a real property.
