Prawo pacjenta do uzyskania opieki medycznej w innych państwie członkowskim Unii Europejskiej stanowi stosunkowo nowe zagadnienie prawne, żywo dyskutowane na europejskim forum. W ramach tej ogólnej tematyki wyróżnia się ponadgraniczne świadczenia medyczne otrzymywane w szpitalach oraz poza nimi (tzw. świadczenia ambulatoryjne). Przedmiotem niniejszego artykułu jest ta druga kategoria. Analizując możliwość skorzystania ze świadczeń przez nią przewidzianych, autor wskazuje, że zostały ona pierwotnie uregulowane w tzw. rozporządzeniach koordynacyjnych UE, wydawanych w związku z przepływem pracowników w ramach Wspólnoty (Unii). Następnie świadczenia tego rodzaju zaczęto uznawać w orzecznictwie Trybunału Sprawiedliwości UE za usługę w traktatowym rozumieniu. Oznaczało to (przynajmniej w teorii) swobodę w ich otrzymywaniu. Istnienie takiej regulacji prawnej, a także ranga swobody przepływu usług spowodowały jednak wiele komplikacji praktycznych. Państwa członkowskie UE, w obawie przed nadmiernymi obciążeniami budżetowymi, wprowadzają w ustawodawstwie krajowym liczne ograniczenia dla uzyskiwania ponadgranicznych świadczeń ambulatoryjnych. Niniejszy artykuł, przedstawiając uprawnienia pacjenta do otrzymania tych świadczeń na obu w/w podstawach, odpowiada na pytanie o możliwość takich ograniczeń. Ponadto, z uwagi na przyjęcie w 2011 roku dyrektywy (która stworzyła niejako trzeci, obok rozporządzeń i orzecznictwa Trybunału, system prawny w przedmiotowym względzie), niniejszy artykuł stanowi swoisty wstęp do rozważań dotyczących praw pacjenta do uzyskania omawianych świadczeń stosownie do tej dyrektywy.

A patient's right to obtain healthcare in another Member State of the European Union is a relatively new legal issue, vividly discussed in the European forum, though. Within such a general subject matter, cross-border medical services received in hospitals and those received outside hospitals (the so-called outpatient services) are singled out. It is the second category which is the purpose of the present article. While analyzing the possibility of making use of services provided for by the very category, the author indicates that they had originally been governed by the so-called EU coordination regulations, issued in connection with the free movement of workers within the European Community (Union). Then, the performances of this kind started to be recognized by the Court of Justice of the EU as constituting ‘service' within the meaning of the Treaty provisions. It denoted (at least in theory) the freedom of receiving such performances. However, the existence of such arrangements, as well as the significance of free movement of services, has resulted in many practical complications. The EU Member States, in fear of excessive budgetary encumbrances, introduce in their national legislation a number of restrictions to obtaining cross-border outpatient services. The present article, while setting out the patients' rights to receive such services on both the above-mentioned bases, is also set to respond to a question concerning the possibility of introducing such restrictions. Furthermore, due to the adoption of a directive in 2011 (which created, so to speak, a third legal system in this regard, apart from the systems based on EU regulations and on case law of the Court, respectively), the present article constitutes a sort of an introduction to deliberations regarding the patients' rights to obtain these benefits in accordance with the provisions thereof.
