In 2012 the European Union regulated for the first time the issue of recognition of producers organisations, associations and unions by the state. Thus a question arises how German law on the structure of the agricultural market should be harmonised with the new EU regulation. The author analyses the new situation and concludes that the introduced instrument of recognition of agricultural organisations and related to it abolition of the cartel agreement prohibition combined with financial support offered to those organisations is adequate to enhance the mutual assistance system existing among agricultural holdings and to improve the dialogue along the food chain. However, its role is doubtful, particularly when it comes to a price crisis. Regardless of how the CAP negotiations end, member states will soon have to face the new challenges identified in the paper.

Nel 2012 l’Unione europea (UE) per la prima volta ha introdotto la regolazione concernente la questione del riconoscimento da parte dello stato delle organizzazioni di produttori, delle associazioni delle organizzazioni di produttori nonché delle associazioni professionali. Su questo sfondo sorge la domanda di come la legge tedesca riguardante la struttura del mercato dovrebbe essere adattata alla nuova regolazione dell’UE in riferimento al sistema delle organizzazioni agricole. Concludendo, l’autore afferma che lo strumento di riconoscimento delle organizzazioni agricole, insieme con la relativa esenzione, legata ad esso, dal divieto di fare cartelli e con il sostegno finanziario a queste organizzazioni, è adeguato al fine di rafforzare l’autoaiuto delle aziende agricole e il dialogo nell’ambito della catena alimentare. Ė dubbioso, tuttavia, se esso serva bene a stabilizzare il mercato agricolo, soprattutto nel caso delle crisi dei prezzi. Indipendentemente dall’esito dei colloqui sulla riforma della PAC in materia di organizzazioni agricole riconosciute, gli Stati membri dell’UE dovranno affrontare a breve i problemi presentati in questo articolo.
