Artykuł opisuje problemy prawne wiążące się z dopuszczalnością zmian w planie finansowym Zakładu Ubezpieczeń Społecznych na przykładzie aktualizacji kosztów wynagrodzeń w kontekście przepisów o finansach publicznych. Zagadnienie nie było przedmiotem pogłębionych opracowań teoretycznoprawnych z zakresu prawa finansowego ani orzecznictwa sądowego, wobec czego podstawową metodą analizy zastosowaną przez autorów jest metoda dogmatyczna, w szczególności analiza przepisów dwóch obowiązujących ustaw: o finansach publicznych oraz o systemie ubezpieczeń społecznych. Autorzy odwołują się też do wykładni językowej i celowościowej, a także historycznej.

The article describes the legal problems associated with admissibility for changes in the financial plan of the Polish Social Insurance Institution (ZUS) based on the example of the updating of remuneration costs within the context of regulations on public finances. The question has not been the subject of extensive theoretical legal works in the field of finance law, or judicial decisions, consequently the basic method for analysis adopted by the authors has been that of dogmatism, in particular an analysis of the regulations of two acts that are in force: on public finance and on the social security system. Th e authors also refer to linguistic, resolute and historical interpretations.
