Prawo upadłościowe jest instrumentem regulującym stosunki społeczne między dłużnikami a wierzycielami. Nowelizacje prawa upadłościowego (w latach 2015 oraz 2020) stworzyły szerszy i łatwiejszy dostęp do upadłości konsumenckiej oraz przyczyniły się do zmian w jej kształtowaniu na przestrzeni ostatnich pięciu lat w Polsce. Rozważania podjęte w pracy koncentrują się na problematyce, zidentyfikowaniu skali oraz analizie porównawczej upadłości konsumenckiej w latach 2015-2020. Podstawową metodą badawczą wykorzystaną podczas analizy była metoda statystyczna. Ponadto przeprowadzono analizę dynamiki i struktury badanego narzędzia ustawowego. Radykalny wzrost liczby ogłoszonych upadłości nastąpił w 2016 roku, kiedy to zwiększenie wyniosło 210 proc. w porównaniu do wartości z 2015 roku. Po kolejnej nowelizacji prawa upadłościowego również można zauważyć tendencję wzrostową. W grudniu 2020 roku liczba ogłoszonych upadłości osiągnęła miesięczny rekord, kiedy to ogłoszono 1809 upadłości. Przewiduje się dalsze utrzymanie trendu w granicach 1200-1800 miesięcznie.

Bankruptcy law is an instrument that regulates social relations between debtors and creditors. The amendments to the bankruptcy law (in 2015 and 2020) created wider and easier access to consumer bankruptcy and contributed to changes in its formation over the last five years in Poland. The considerations undertaken in the paper focus on the issues, identification of the scale and comparative analysis of consumer bankruptcy in 2015-2020. The basic research method used during the analysis was statistical method. In addition, an analysis of the dynamics and structure of the studied statutory tool was conducted. A radical increase in the number of declared bankruptcies occurred in 2016, when the increase was 210 proc. compared to the value in 2015. After another amendment of the bankruptcy law, an upward trend can also be observed. In December 2020, the number of declared bankruptcies reached a monthly record, when 1,809 bankruptcies were declared. The trend is expected to continue between 1,200 and 1,800 per month.
