This article analyzes the problems stemming from the use of the phrase „will lose binding effect on […]” in the Polish legal language. The author points out that this expression is understood differently by persons drafting the legal acts with regards to the moment of loss of binding effect of a normative act or its particular provisions. Most often it is used to determine the end of the last day in which the act or provision is in force. In some cases, however, it is used to determine the first day after the period in which the act has binding effect. It results in such inconsequence that in order to establish the date on which the loss of binding effect should occur with the end of 31st December, some drafters use the expression “loses binding effect on 31st December”, while others “loses binding effect on 1st January”. In the article, it is pointed out that there is lack of linguistic rules which would allow to solve that dilemma and help to decide which alternative is correct. After analysis of the “Principles of the Legislative Techniques” and sparse scientific publications and judgments, the author makes a proposal to eliminate the said inconsistency from the legislation practice.
