Problem porozumień ubezpieczycieli o bezpośredniej likwidacji szkód został przedstawiony z punktu widzenia prawa ochrony konkurencji i konsumentów (prawa antymonopolowego). W pierwszej kolejności przeanalizowano, jaki jest wpływ tych porozumień na konkurencję na rynku ubezpieczeniowym. Wykazane zostało, iż wpływ ten można zakwalifikować jako ograniczanie konkurencji na rynku właściwym, zakazane zarówno przez prawo krajowe, jak i unijne. Ponieważ obydwa porządki prawne dopuszczają wyłączenie niektórych porozumień spod zakazu ze względu na to, że per saldo wynika z nich dla konkurencji i konsumentów więcej korzyści niż strat, w artykule poddano analizie zagadnienie, czy porozumienia o bezpośredniej likwidacji szkód są w stanie spełnić przesłanki uzasadniające ich wyłączenie.

The present article is devoted to the overview of the insurers' agreements on direct claims settlement from the point of view of competition and consumer protection law (antitrust law). Firstly, the impact of these agreements on competition in the insurance market has been studied. Secondly, it has been shown that this influence can be classified as a restriction of competition on the relevant market, prohibited by both national and the EU legislations. Furthermore, because the two legal orders allow the exemption of certain agreements from the prohibition due to the fact that on balance they bring consumers and competition more benefits than losses, it has been analysed in the article whether the agreements on direct claims settlement meet the conditions justifying their exemption.
