The aim of the article is to identify the problem of land and soil degradation and to recognise the need to counteract these processes as a challenge for the law and policy. The importance of this issue and its connection with the globalisation of food systems (especially the need to consider the interdependencies existing between the aspects of globalisation of food systems and land degradation) has been highlighted and the state of protection of soil and land under international and European Union law described. Given the global effects of land degradation and land scarcity and the fact that regional and local land use decisions are heavily dependent on geographically distant factors, legal instruments to combat land and soil degradation that are local or regional in nature may not be sufficient. Hence the need for action through instruments of international environmental law.

L’articolo si propone di individuare il problema di degrado della terra e del suolo nonché di riconoscere la necessità di contrastare questi processi in quanto sfide per la legge e la politica. L’Autrice fa notare l’importanza della questione sollevata, concentrandosi anche su possibili connessioni con il processo di globalizzazione dei sistemi alimentari (in particolare sulla necessità di prendere in considerazione le interconnessioni tra gli aspetti di globalizzazione dei sistemi alimentari e il degrado della terra), presenta inoltre lo stato di tutela del suolo e della terra nel diritto internazionale ed europeo. Visti gli effetti globali del degrado della terra e i fenomeni legati al problema della sua scarsità, a cui si aggiunge il fatto che le decisioni regionali e locali riguardanti l’uso del terreno dipendano fortemente da fattori geograficamente remoti, gli strumenti giuridici, di carattere locale o regionale, volti a contrastare il degrado della terra e del suolo non possono essere giudicati sufficienti. Ciò porta a una conclusione – a indicare la necessità di agire con strumenti di diritto ambientale internazionale.
