The selection of legal orders presented in this paper is not accidental as they are an example of two different approaches to the newest biotechnological achievements in the food and agriculture sector. The restrictive model that has been so far applicable in the European Union with regards genetically modified organisms stands in direct contrast to the liberal American model. As can be seen from the analysis of the two, both approaches reflect, to a certain extent, the position enjoyed by respective lobbying groups in the UE and the US. A substantial part of the paper focuses on the prudence and equality principles. The regulation on launching GMOs on the market seems to be dependent on which one of these two constitutes the axiological foundation of the regulation.

Le selezione degli ordini giuridici indicati non è casuale in quanto essi vengono considerati come esempio di rilievo di un approccio differente alla questione della diffusione delle più recenti scoperte della biotecnologia nel settore agroalimentare. Il modello giuridico restrittivo, finora sviluppato da parte del legislatore dell’UE, riguardante gli organismi geneticamente modificati contrasta in modo inequivocabile con il modello americano liberale. L’autrice afferma che la forma del diritto dell’UE e degli Stati Uniti costituita in questo ambito è in qualche misura un riflesso della posizione di cui godono i vari gruppi di pressione negli USA e nell’UE. Una parte importante di questo articolo si concentra sulla discussione riguardante il principio di precauzione e il principio di equivalenza. Il modo di regolare l’immissione in circolazione degli organismi geneticamente modificati varia notevolmente a seconda di quale di questi principi costituisce un fondamento assiomatico della regolazione.
