System characteristic includes determining its composition (elements) and structure (relations between elements). The catalog of sources (elements of the system) of universally binding law, designed in the Constitution of the Republic of Poland of 1997, contrary to popular belief, is not subjectively or objectively closed, assuming that a closed catalog is an abundant enumeration of elements, and not only a definition of the types of sources of law (from due to local law and secondary law of an international organization). Therefore, the catalog remains open, although at the national level the regulation is indeed abundant. Narrowing the circle of entities authorized to issue a regulation is an overly rigorous solution, resulting in problems of a functional nature, not occurring e.g. under the rule of the interim constitution of 1992. From the perspective of the effectiveness of the system of sources of law and legal certainty, it seems more important and sufficient to precisely define the structure of the system.
