Wraz ze starzeniem się społeczeństwa rośnie znaczenie zabezpieczenia społecznego osób sprawujących opiekę długoterminową nad osobami niezdolnymi do samodzielnego funkcjonowania. Zwłaszcza w społeczeństwie takim jak polskie, w którym dużą rolę w zaspokajaniu potrzeb opiekuńczych osób niesamodzielnych odgrywa rodzina, szczególnie potrzebna jest polityka zabezpieczenia społecznego nie tylko tych wymagających opieki, ale też tych, którzy ją sprawują, nierzadko kosztem życia zawodowego. Artykuł ma ukazać stan zabezpieczenia społecznego tej grupy w Polsce w kontekście wyzwań, jakie stoją przed parlamentem VIII kadencji. Przełom polityczny z 2015 r. sprzyja temu, by dokonać bilansu tego, co już udało się osiągnąć, i wskazać, z jakimi zadaniami będzie się musiała zmierzyć stosunkowo niedawno wybrana nowa władza. Autor wyróżnia jako priorytetowe trzy zagadnienia, a następnie dokładnie je omawia, przedstawiając także propozycje rozwiązań i problemy, jakimi miał się zająć Sejm w poprzedniej kadencji. Za najbardziej złożony z nich, wymagający ponadto pilnego uregulowania, uznana została kwesti a osób wykluczonych w ramach systemu opiekuńczych świadczeń rodzinnych, czyli opiekunów dorosłych osób niepełnosprawnych. Szczególnie istotna jest realizacja wyroku Trybunału Konstytucyjnego, który orzekł, że dotychczasowe regulacje kolidują z zasadami zapisanymi w ustawie zasadniczej. Należy również przyjrzeć się sprawie matek, które są na wcześniejszych emeryturach i opiekują się niepełnosprawnymi dziećmi, oraz kwesti i zabezpieczenia opiekuna po śmierci podopiecznego. Celem przyświecającym artykułowi jest zidentyfi kowanie i wyjaśnienie problemów, których rozwiązania – zdaniem autora niniejszego opracowania – powinien się pilnie podjąć ustawodawca.

Together with an ageing society there increases the importance of social security for those providing long-term care for those unable to look after themselves and to function independently. Particularly in a society like that in Poland, where to a large extent it is the family that provides the support to care for those unable to look after themselves there is an overriding need for social insurance policy to cover not only those in need of care but equally those who provide this very care; often at the price of their own professional lives and employment. Th e article sets out to show the state of social security care for this group in Poland within the context of the challenges before this most recent 8thparliamentary term of offi ce. Th e political breakthrough is conducive to conclude a balance of what has been achieved and to show what tasks await the relatively recently elected authorities and what they will have to deal with. Th e author has highlighted as priorities three problem areas, and subsequently describes them in detail presenting also proposals for their resolution and the problems which the Polish parliament (the Sejm) had to deal with during the previous parliamentary term of offi ce. Th e most complex of which, and demanding fi rst and foremost urgent attention, is the matter of those excluded within the family care payment system framework, that is those adults caring for disabled family members. Of especial note is the realisation of the judgement of the Constitutional Tribunal which stated that hitherto regulations are contrary to the principles engrained in the Polish Constitution. It also follows to examine the question of mothers who have opted for early retirement in order to look after disabled children, as well as the question of the protection of a carer after the death of those cared for by them. It is the aim of the article to identify and elaborate those problems, the solution of which is in the author’s opinion something that should be immediately undertaken by the legislator.
