According to the constitution, Republic of Poland is a democratic state ruled by law, where the system of government shall be based on the separation of and balance between the legislative, executive and judicial powers. Very important is, that the courts and tribunals shall constitute a separate power and shall be independent of other branches of power. Unfortunately in Poland, like in other counties, we can notice attempts by the politicians to subordinate the Constitutional Tribunal and courts. This is a task for judges to counteract this, which is possible because there is a provision in Polish Constitution, that The Constitution shall be the supreme law and the provisions of the Constitution shall apply directly, unless the Constitution provides otherwise.
