Czech Civil Service Act: Is It Up to International Anti Corruption Standards?

The adoption of the Civil Service Act in the Czech Republic was accompanied by many internal political conflicts as well as by international influence. Moreover, it has undergone a very complicated legislative process, and the Constitutional Court eventually evaluated it. What is the final shape of this act? The author poses a question to what extent the Civil Service Act corresponds to international standards, recommendations and best practice related to the regulation of civil service. The Act is, therefore, subject to thorough analysis using parameters that are presented by the Anticorruption Barometer. Even though the original purpose of the Anticorruption Barometer is to measure success and quality of the Government anti-corruption policy, the parameters used by it were set in accordance with international standards, recommendations, and best practice. The author confronts the individual parameters of the Barometer with the wording of the Act and concludes that even though the Civil Service Act means undoubtedly a step towards improving the situation many steps that were taken are insufficient and the Act leaves space for political influence on civil service, patronage, and corruption.
