The penal policy as a part of the common policy formulates the aims and the means of crime control by society using the penal law. The penal policy-making is also the subject of competition of political parties; the penal policy and its orientation are under the significant influence of the media that influence the public opinion. In a democratic state the penal policy may also be considerably influenced by non-governmental organisations and organisations with moral (religious) authority. The invariables of penal policy, that have been influencing the penal legislation and practice for a long period, are expressed in the Czech Republic e.g. in the Charter of Fundamental Rights and Freedoms and in the draft of the new penal law.
