The article describes the factual and legal status and formal and legal way for the creation of an Modlin airport. The article shows the problems that have occurred after the mayor of Nowy Dwór Mazowiecki has made a decision, which allowed work to begin investment. Comment authors concerned the complaints that were brought to court by environmental groups that opposed the creation of the airport. This article is the result of scientific interests of authors.
