Applying to competent administrative agency begins the administrative procedure. Therefore – accordingly to the art. 65 § 1 of administrative procedure code - in case the administrative authority considers itself as objectionable, it is obliged to promptly pass on the application to the competent administrative body. This rule specify the action, to which the authority is obliged in occurrence of his legal inability to run and settle down the case accordingly to the party’s claim. The aim of the normalization contained in the provision is to protect the party from negative consequences of incorrect initiation of legal proceedings. The paper also refers to the regulation from before the amendments of the administrative procedure code in order to show that new provisions leads to create administrative procedure less formal.
