Ustawa Prawo telekomunikacyjne wprowadza do polskiego prawa pojęcie tajemnicy telekomunikacyjnej. Przez to pojęcie rozumie się ochronę danych telekomunikacyjnych. Na podstawie tych danych tworzone są jednak zestawienia billingowe, służące do rozliczeń połączeń danego abonenta. Sprawia to, że dane telekomunikacyjne mogą zostać ujawnione, a tym samym złamana może być tajemnica telekomunikacyjna. Szczególnie że w prawie telekomunikacyjnym znaleźć można wiele luk prawnych.

The Telecommunications Law Act introduces the concept of telecommunications secrecy into the Polish Law. It is understood to mean protection of telecommunications data. The data form, however, the basis for call data records, used to bill the phone calls made by a given subscriber. Therefore, telecommunications data can be disclosed, and thus telecommunications secrecy can be breached. The more so, as many legal loopholes can be found in the Telecommunications Law.
