Artykuł przybliża specyfikę prawa dziecka do partycypacji, wskazując, że choć jest ono jednym z filarów praw dziecka w ogóle, stanowi spore wyzwanie, zarówno jeśli chodzi o jego rozumienie (wielość znaczeń, jakie można przypisać dziecięcej partycypacji), jak i urzeczywistnianie (uprzedzenia dotyczące myślenia o dzieciach jako aktywnych, sprawczych aktorach społecznych). Analizuję w nim rozumienie prawa do partycypacji zawarte w Konwencji o prawach dziecka. Przede wszystkim jednak moim celem jest podświetlenie kilku znaków zapytania, wątpliwości i problemów związanych z partycypacją dzieci, wynikających w dużej mierze, choć nie tylko, z asymetrii szeroko rozumianej władzy w relacjach między dziećmi a dorosłymi. Mając zwłaszcza na uwadze kontekst dzieci marginalizowanych, partycypację traktuję tutaj nie tylko jako prawo, które dziecko może egzekwować vis-a-vis dorosłych czy systemu, ale również jako relację między nim a dorosłymi i – szerzej – kontekstem społecznym. W obrębie tej relacji wskazuję z kolei trzy wątki, które w moim odczuciu są istotne dla jej budowania: sprawstwo, zaufanie i etyka troski. Nie traktuję ich przy tym jako odpowiedzi na pytanie o to, jak powinno być realizowane prawo dziecka do partycypacji, ale raczej jako kontekst, w jakim warto o nim myśleć.

The article introduces the specificity of a child’s right to participation. Although it is considered as one of the pillars of children’s rights – a right to participation presents a challenge – both when it comes to its understanding (children’s participation has many different meanings) and its realisation (embodied by uneasiness of viewing children as active social actors). I analyse how it is defined in the context of the Convention on the Rights of the Child. Most importantly however, I try to highlight some of the questions and problematic issues that children’s participation brings about, noting that most of them stem from the asymmetry of power in child-adult relations. Focusing on the marginalised children, I look into the three important aspects of child-adult relations that – albeit not unproblematically – shape the way we may think of children’s participation. These are: agency, trust and the ethics of care.
