The article deals with the question of the presence of homosexuality under conditions of military service in the United States. The legal perspective of the text is embedded in the comprehensive reflection from the field of philosophy and psychology that constitutes its important background as some integral strand of narrative. The key notion of the whole text concentrates on patriarchy as a model of power, its conception and execution – and some source of acute and primary experiences that touch people. The system of patriarchy is founded on discrimination and the figure of a homosexual as the target of that discrimination and the rationale of patriarchy’s legitimisation appears as well. The institution of the army is a very essential and concentrated laboratory of patriarchal processes. The text has an ambition to present not only the work of patriarchy but also: some ways of effective conversion of destructive aspects of patriarchy into the constructive state of individual and (consequently) social wellness as some optimal state for military goals and tasks’ realisation.

Artykuł dotyczy kwestii obecności homoseksualizmu w warunkach służby wojskowej w Stanach Zjednoczonych. Perspektywa prawna tekstu zakotwiczona jest we wszechstronnej refleksji z dziedziny filozofi i i psychologii; konstytuuje ona jego istotne tło jako pewną integralną oś całej narracji. Kluczowe pojęcie całego tekstu koncentruje się na patriarchacie jako modelu władzy, jej koncepcji i egzekucji – i istotnym źródle przenikliwych i pierwotnych doświadczeń dotykających ludzi. System patriarchatu jest ufundowany na dyskryminacji i pojawia się również figura homoseksualisty jako celu tej dyskryminacji i ratio dla legitymizacji patriarchatu. Instytucja wojska to bardzo esencjonalne i skoncentrowane laboratorium patriarchalnych procesów. Ambicją tekstu jest zaprezentować nie tylko działanie patriarchatu, lecz również konkretne sposoby efektywnej konwersji destruktywnych przejawów patriarchatu w konstruktywny stan indywidualnego i (w konsekwencji) społecznego dobrostanu jako pewnego stanu optymalnego dla realizacji celów i zadań militarnych.
