Celem artykułu jest określenie miejsca sądów starosty generalnego w systemie sądownictwa Żmudzi, w okresie od 1450 r. (czyli od momentu, kiedy urząd ten objął Jan Kieżgajłowicz) do reformy sądowo-administracyjnej przeprowadzonej w 1566 r. Dla lat wcześniejszych przedstawiono tylko kilka hipotetycznych uwag. W badanym czasie można wydzielić dwa okresy: przed i po wydaniu I Statutu Litewskiego (1529). Na podstawie ok. 200 dokumentów sądowych, zebranych z różnych zespołów rękopisów, i aktów ksiąg spraw sądowych Metryki Litewskiej możemy rekonstruować niektóre aspekty działalności tego sądu, w tym: zakres jego kompetencji, stosunek do sądów wielkich książąt i sądów dzierżawców (mniejszych starostów), jego skład, sąd podstarościego, miejsce zebrania sądu, czas roków sądowych.

The purpose of the article is to determine the place of the elders’ court within the judicial system of Samogitia in the period from 1450 (i.e. from the time when Jonas Kęsgaila, or Kęsgailaitis, took office) to the legal and administrative reform carried out in 1566. Only a few hypotheses have been presented for the earlier years. It is possible to divide the analysed time into two periods: before and after the First Lithuanian Statute (1529). Based on ca 200 documents from various manuscript collections and the Metrica of the Grand Duchy of Lithuania it is possible to reconstruct some aspects of this court’s operations, including its jurisdiction, attitude towards the courts of grand dukes and courts of tenutaries, its composition, the court of vice-elders, and the place and time of court sessions.
