Gdy w grę wchodzi zawarcie małżeństwa konkordatowego per procura, czynności administracyjne i cywilnoprawne poprzedzające zawarcie małżeństwa w formie wyznaniowej ze skutkami cywilnymi w prawie polskim ujawniają istotne wątpliwości. Dotyczą one wszystkich podmiotów uczestniczących w tym postępowaniu, to jest obowiązków nupturientów, pełnomocnika, kierownika USC, a także duchownego. Wątpliwości istnieją także co do zakresu kognicji sądu prowadzącego postępowanie w przedmiocie udzielenia zgody na zawarcie małżeństwa przez pełnomocnika.Artykuł poprzez analizę obowiązujących uregulowań polskiego kodeksu prawa rodzinnego, kodeksu postępowania cywilnego, ustawy Prawo o aktach stanu cywilnego oraz prawa wewnętrznego Kościoła katolickiego zawiera próbę odpowiedzi na te pytania.

Administrative and civil law actions preceding a religious marriage with civil legal effects seem to be regulated in great detail by the valid legislation and analysed quite well in the doctrine. However, a more thorough analysis shows that regarding a concordat marriage per procura, significant questions may arise concerning the parties participating in the proceedings, i.e. the obligations of the future spouses, a proxy, the registrar and the priest. There are also some questions regarding the jurisdiction of the court which conducts the proceedings for granting permission to marry by proxy.This article attempts to address these issues by analysing the valid regulations of the Polish Family and Guardianship Code, Code of Civil Proceedings, Civil Registry Records Act and the internal laws of the Catholic Church.
