Abstracts
The statement according to which the legal condition currently present in the area of the European Union does not fulfill the hopes rested in it, is surely a disputable matter. Undoubtedly within the compass of the last several dozen years of integration processes many problems have arisen, which are difficult to explain by virtue of solutions currently in force. Voices are rising that the European Union is facing the dilemma between the eff ectiveness and democraticity of decisive processes. It is difficult to explicitly point out whether the reasons for such a condition are the faulty legal regulations, and, what is perhaps the most important, to what extent is it possible to improve it through changes in the Union’s legislation. The dilemmas concern both, the choice of theoretical conception on which the whole construct would be based, as well as the legal-organizational shape of the Union’s structures.
