Przedmiotem wyroku Trybunału Konstytucyjnego z 11 maja 2023 r. była ocena zgodności z Konstytucją RP przepisu art. 22 ust. 5 pkt 3 ustawy z 23 lipca 2003 r. o ochronie zabytków i opiece nad zabytkami. Przedmiotowa regulacja ograniczała prawo własności nieruchomości poprzez dopuszczenie jej ujęcia jako zabytku w gminnej ewidencji zabytków. Następowało to bez zapewnienia właścicielowi gwarancji ochrony prawnej przed dokonaniem takiego ograniczenia. Trybunał – uznając ów przepis za niezgodny z ustawą zasadniczą – wskazał, że nie jest niezbędny do ochrony interesu publicznego, a efekty jego zastosowania nie pozostają w dopuszczalnej proporcji do ciężarów nakładanych na właścicieli nieruchomości. Wyrok TK rozstrzygnął zatem kluczową kwestię, przesądzając o konieczności udzielenia właścicielowi nieruchomości skutecznej gwarancji ochrony prawnej przed dokonaniem takiego ograniczenia.

The subject of the judgment of the Constitutional Tribunal of May 11, 2023 was the assessment of the compliance with the Constitution of the Republic of Poland of the provision of Art. 22 sec. 5 point 3 of the Act of July 23, 2003 on the protection and care of monuments. The regulation in question limited the ownership right to real estate by allowing it to be included as a monument in the municipal register of monuments. This occurred without providing the owner with a guarantee of legal protection against such a restriction. The Tribunal – finding this provision inconsistent with the Constitution – stated that it was not necessary to protect the public interest, and the effects of its application were not in proportion to the burdens imposed on property owners. The judgment of the Constitutional Tribunal therefore resolved a key issue, deciding on the need to provide the property owner with an effective guarantee of legal protection against such a restriction.
