This paper discusses guidelines for implementation of art. 107-109 of the Treaty on the Functioning of the European Union, from perspective of state guarantees for banks in wake of the financial crisis which descended on EU Member States. Qualitative analysis of bank loan guarantees was based on The Banking Communication of 13 October 2008. Statistical data for quantitative analysis was collected from European Commission reports issued about state aid granted to Member States. Discussed were criteria for granting that aid, verifying its objectives as well as measures and amounts approved by the Commission. Research theory was set out that the banking loans guarantees as a state aid instrument were used predominantly by countries within the Euro zone, whilst states without the common currency had little in the way of that aid.
