This article analyses mandatory mediation in the context of everyone’s right to a fair trial as it is guaranteed by the Constitution and international as well as the European Union law. The author’s starting point is the example of the Italian jurisdiction. Then, two verdicts of the Tribunal of Justice of the UE referring to the issue are presented, namely the verdicts in the case of Rosalba Allasini and in the case of Livio Menini. They provide a framework for analysing mandatory mediation under Polish law. An attempt to answer a question whether mandatory mediation might be an effective instrument to counteract one of the greatest dysfunctions of contemporary justice system which is lengthiness of court proceedings.

W artykule omówiono zagadnienia mediacji obligatoryjnej w kontekście zagwarantowanego konstytucyjnie oraz przez źródła prawa międzynarodowego i unijnego prawa do sądu. Punktem wyjścia rozważań było ustawodawstwo włoskie w tym zakresie. Następnie przedstawiono dwa orzeczenia Trybunału Sprawiedliwości Unii Europejskiej (TS UE) dotyczące omawianej kwestii, tj. wyroki w sprawach Rosalba Allasini i Livio Menini. Na ich tle przeprowadzono analizę zagadnienia mediacji obligatoryjnej na gruncie prawa polskiego. W podsumowaniu podjęto próbę udzielania odpowiedzi na pytanie, czy mediacja obligatoryjna mogłaby stanowić skuteczny instrument przeciwdziałania jednej z głównych dysfunkcji działania współczesnego wymiaru sprawiedliwości, tj. przewlekłości postępowań.
