Doprowadzanie wody przez cudzy teren jest konieczne wszędzie tam, gdzie dostęp do niej nie jest jednakowy dla wszystkich. W Egipcie, w którym prawie cała ziemia nawadniana była dzięki corocznemu wylewowi Nilu, woda z którego rozprowadzana była za pośrednictwem rozbudowanego systemu irygacyjnego, składającego się z basenów zalewowych, był to jednak problem marginalny. Dlatego też znajdujemy tylko nieliczne papirusowe poświadczenia tego zjawiska w Egipcie ptolemejsko-rzymskim, które są przedmiotem niniejszego artykułu. Wyraźnie wskazują one, że potrzeba doprowadzania wody przez cudzy teren ograniczona była do gruntów wymagających całorocznego nawadniania, co wyraźnie poświadczone jest w odniesieniu do winnic. Nawadniane były one za pośrednictwem zbiorników i różnego rodzaju urządzeń hydraulicznych, nieznajdujących się na każdej z działek, co rodziło potrzebę doprowadzania wody z nich przez obce grunty. Wskazuje to jasno, jak uregulowania prawne z zakresu prawa wody były ściśle związane ze specyfką hydrologiczną danego terenu.

The supply of water across another proprietor’s land is necessary wherever not all users have the same access to water. In Egypt, where virtually all the land was irrigated by the Nile’s annual flooding, the floodwater was distributed through an elaborate irrigation system of floodplains, so water access was a marginal problem. There are only a few papyri extant with evidence of this phenomenon in Graeco-Roman Egypt, and they are the subject of this article. They clearly indicate that the need to bring water across someone else’s property was limited to land requiring irrigation all year round. This was observed for vineyards, which were irrigated by means of reservoirs and various types of hydraulic devices not located on each plot. Hence to bring water from them over neighbouring properties. This shows how the legal regulations on water were strictly connected with the hydrological conditions of a given area.
