The Act of 20 July 2018, Law on Higher Education and Science, has changed the current rules of organization of higher education in Poland. Polish universities were obliged by the Act to adapt their internal organizations and processes occurring in them to the new requirements within 12 months from the date of its entry into force. The new regulations also touched upon the issues of the position and role of student self-government in the university management process. The first aim of this article is to analyse the rights of student self-government provided for in the Act of 20 July 2018 Law on Higher Education and Science and to answer the question whether new regulations expand or limit the current role of student self-government. The second goal of the article is to present the opinions of the representatives of student self-government regarding selected regulations affecting the rights of this body. All considerations are based on a brief historical outline of student self-government in Poland, a description of the legislative process of the so-called Act 2.0, a comparative approach to the rights of student self-government in two legal states and a survey of students acting in student self-government.

Ustawa z dnia 20 lipca 2018 r. Prawo o szkolnictwie wyższym i nauce zmieniła dotychczasowe zasady organizacji szkolnictwa wyższego w Polsce. Uczelnie zostały zobowiązane, aby w terminie 12 miesięcy od dnia jej wejścia w życie dostosować swoje wewnętrzne organizacje i procesy w nich zachodzące do nowych wymagań. Nowe regulacje dotknęły również problematyki pozycji i roli samorządu studenckiego w procesie zarządzania uczelnią. Pierwszym z celów niniejszego artykułu jest analiza uprawnień samorządu studenckiego w świetle zapisów ustawy z dnia 20 lipca 2018 r. Prawo o szkolnictwie wyższym i nauce, w tym próba odpowiedzi na pytanie, czy nowe regulacje rozszerzają, czy ograniczają dotychczasową rolę samorządu studenckiego. Drugim z celów artykułu jest zaprezentowanie opinii przedstawicieli samorządów studenckich dotyczących wybranych regulacji dotykających uprawnień samorządu studenckiego. Całość rozważań prowadzona jest w oparciu o krótki rys historyczny samorządności studenckiej w Polsce, opis procesu legislacyjnego tzw. ustawy 2.0, ujęcie porównawcze uprawnień samorządu studenckiego w dwóch stanach prawnych oraz badanie ankietowe studentów działających w samorządzie studenckim.
