EN

The judgment concerns the staging of investments with regard to the issuing of a building permit by the competent authority. The court decided that for the first stage of the investment, the public administration body, when deciding on the building permit, should comprehensively assess the development project, so that during the next stages of the investment, such a project would no longer be the subject of analysis and resolution.

Wyrok dotyczy etapowania inwestycji w przedmiocie wydawania przez właściwy organ pozwolenia na budowę. Sąd uznał, że dla pierwszego etapu inwestycji, organ administracji publicznej przy rozstrzyganiu kwestii pozwolenia na budowę powinien w sposób kompleksowy ocenić projekt zagospodarowania, aby podczas kolejnych etapów inwestycji,  projekt taki nie był już przedmiotem analizy i rozstrzygania.
