Zjawiskiem powszechnym stały się coraz częstsze kontrole płatników składek przez Zakład Ubezpieczeń Społecznych. Obejmują one w dużej mierze zasadność zwierania przez płatników składek umów o dzieło i nierzadko kończą się uznaniem, że umowy te powinny być zawarte w formie umów zlecenia. Celem artykułu jest rozważanie prawnej dopuszczalności dokonywania przez ZUS kwalifikacji umów o dzieło jako umów zlecenia w perspektywie zasady swobody umów, kompetencji ZUS-u do dokonywania takiej kwalifikacji, jak również kompetencji do wykładni i stosowania przepisów Kodeksu cywilnego. Problematyka omówiona została na tle umów zawieranych z twórcami i artystami.

The controls of contribution payer conducted by the Social Insurance Institution (ZUS) has become more frequent and common phenomenon. The above includes, inter alia, the legitimacy to concluding a contract to perform a specified task by a contribution payer and often ends with recognition that these contracts should be concluded in the form of mandate contracts. The purpose of the paper is to consider the legal admissibility of qualifications of contract to perform a specified task as a contract of mandate conducting by ZUS in the light of the concept of freedom of contract and ZUS competence to conduct such a qualification, as well as competence to interpret and apply the provisions of the Civil Code. The issue was discussed in the context of contracts concluded with creators and artists.
