The article presents the issue of protection of fictional characters in the copyright and related rights. A fictional character is created by the author in a creative form of literature, film, with unique characteristics and appearance. Accepted definition has allowed the creation of the scope of protection. It is protected as a component part of the song and as a standalone item. The way this protection depends on the nature of the form, its originality and existence in the minds of the customer. In the article in addition to the doctrinal considerations on the essence of protection, discusses the litigation in this area. The analysis was based on the case-law of the Polish, French and English.

Artykuł przedstawia problem ochrony postaci fikcyjnej w prawie autorskim i prawach pokrewnych. Postać fikcyjna to wykreowana w sposób twórczy przez autora postać z literatury, filmu, posiadająca unikatowe cechy charakteru i wyglądu. Przyjęta definicja pozwoliła na stworzenie zakresu ochrony. Jest ona chroniona jako część składowa utworu i jako samodzielny element. Sposób tej ochrony zależy od charakteru danej postaci, jej oryginalności i istnienia w świadomości odbiorcy. W artykule oprócz doktrynalnych rozważań nad istotą ochrony, omówiono sprawy sądowe w tym zakresie. Analiza została oparta na orzecznictwie polskim, francuskim i angielskim.
