This article deals with the issue of protection of entrepreneurs’ rights in the course of administrative and tax proceedings. The Constitution of Business has introduced a special catalogue of general principles. Additionally, the institution of the Small and Medium Enterprises Ombudsman has been established. In the opinion of the Author, the adopted regulations clearly indicate the special role of an entrepreneur in a democratic rule of law.

Niniejszy artykuł porusza zagadnienie ochrony praw przedsiębiorców w toku postępowania ogólnego administracyjnego oraz podatkowego. Konstytucja Biznesu wprowadziła szczególny katalog zasad ogólnych. Dodatkowo została powołana instytucja Rzecznika Małych i Średnich Przedsiębiorców. W opinii Autora, przyjęte regulacje wskazują wyraźnie na szczególną rolę przedsiębiorcy w demokratycznym państwie prawnym.
