Criminal Liability for Evasion of a Compensatory Measure

The problem of this study is to determine whether in the current legal state there is a need to criminalise behaviour consisting in evading execution of a compensation measure ordered by a court and imposed on the basis of Article 46(1) of the Penal Code. In the case of a positive answer to the above question, it should be considered whether there is a need to introduce a regulation to fill it, to assess the proposed changes and to formulate de lege ferenda proposals. The basis for the present deliberations will be the Act of 13 June 2019 on amending the Act, the Penal Code and some other acts and the draft Act of 14 May 2019 on amending the Act – Penal Code and some other acts together with the justification, as well as legislative materials and opinions of the scientific community on the proposed regulations.

Problematyką niniejszego opracowania jest ustalenie, czy w obowiązującym stanie prawnym istnieje potrzeba penalizacji zachowania polegającego na uchylaniu się od wykonania orzeczonego przez sąd środka kompensacyjnego, nałożonego na podstawie art. 46 § 1 k.k. W przypadku odpowiedzi pozytywnej na powyższe pytanie należy rozważyć, czy zachodzi potrzeba wprowadzenia regulacji w celu jej zapełnienia, ocenić zaproponowane zmiany i sformułować propozycje de lege ferenda. Bazę dla niniejszych dywagacji stanowić będzie ustawa z dnia 13 czerwca 2019 r. o zmianie ustawy – Kodeks karny oraz niektórych innych ustaw oraz projekt ustawy o zmianie ustawy – Kodeks karny oraz niektórych innych ustaw z dnia 14 maja 2019 r. wraz z uzasadnieniem, a także materiały legislacyjne i opinie środowiska naukowego na temat proponowanych regulacji.
