EN

Interest on trial costs is a new regulation in the Polish civil procedure. The solution adopted by the legislator, although going in the right direction, raises both theoretical and practical doubts. The main problem is to determine whether the interest should be included in the judgment closing the case, as part of the costs of the trial, or whether it's awarded in some other form. Answering this question implies further problems, particularly related to the challengeability of such a decision. The analysis of the provisions allows to conclude that interest forms part of the costs of the process, with all the consequences.

Odsetki od kosztów procesu stanowią nową regulację w polskiej procedurze cywilnej. Przyjęte przez ustawodawcę rozwiązanie, chociaż zmierzające w dobrym kierunku, budzi wątpliwości zarówno natury teoretycznej, jak i praktycznej. Podstawowym problemem jest ustalenie, czy omawiane odsetki należy umieszczać w orzeczeniu kończącym postępowanie w sprawie, jako część kosztów procesu, czy też są przyznawane w jakiejś inne formie. Odpowiedź na to pytanie implikuje kolejne problemy, szczególnie związane z zaskarżalnością takiego rozstrzygnięcia. Analiza przepisów pozwala na wyciągnięcie wniosku, że odsetki stanowią część kosztów procesu, ze wszelkimi tego konsekwencjami.
