The article defines the basic organization and legal problems which apply new investment instrument, which is a Real Estate Investment Trust. The history, legal conditions and the background of those funds, were shown on the basis on the United States funds where they have a beginning and also on basis on other European countries. The current legal status which is still discuss was indicated basis on all current bills. Main assumptions, which are the tax exemptions for entities investing in those funds, have been presented.

W artykule przedstawiono podstawową problematykę organizacyjną i prawną nowego instrumentu inwestycyjnego, czyli funduszu typu Real Estate Investment Trust. Przedstawiono historię, uwarunkowania prawne oraz podłoże tego typu funduszy w Stanach Zjednoczonych, skąd się wywodzą a także w innych krajach europejskich. Obecny status prawny, który jest wciąż dyskutowany został przedstawiony na podstawie wszystkich dotychczasowych projektów ustaw. Omówiono główne założenia, którymi są zwolnienia podatkowe podmiotów inwestujących w tego typu fundusze.
