Equity as an argument in legal discourse on example of the case law

The aim of the article is to analyze the equity in Polish jurisprudence in the context of its use as an argumentation tool. The author seeks answers to the following questions: do courts adjudicate only on the basis of law regulations or do they also take into account other factors, e.g. equity considerations? For what purpose do the courts invoke the argument of equity? The law is supposed to be the art of what is good and right, but it becomes almost a slogan if it is not specified for what purpose and what kind of goodness or righteousness is used. The article also presents examples of case law confirming the thesis that changes in society affect the way courts adjudicate.

Celem artykułu jest analiza słuszności w polskim orzecznictwie sądowym w kontekście jego stosowania jako narzędzia argumentacji. Autorka szuka odpowiedzi na następujące pytania: czy sądy orzekają tylko na podstawie przepisów czy może biorą pod uwagę również inne czynniki np. względy słuszności? W jakim celu sądy powołują się na argument ze słuszności? Prawo ma być sztuką tego, co dobre i słuszne, jednak staje się to niemal sloganem, jeśli nie zostaje dookreślone, w jakim celu i jaka dobroć bądź słuszność jest stosowana. W artykule przedstawione są również przykłady z orzecznictwa potwierdzające tezę, że zmiany zachodzące w społeczeństwie mają wpływ na sposób orzekania przez sądy.
