The study compares to the issue of the right to refuse to testify by a witness in accordance to article 182 § 3 of the Code of Criminal Procedure. The aim of the article is to present the institution of a witness’s refusal to testify in a situation where he is the accused in another pending proceeding, the question of whether such refusal to testify by a witness is entitled and who makes such an assessment. The study also focuses on the impact of the current meaning of article 182 § 3 of the Code of Criminal Procedure on the pending proceedings, on the principle of the defendant’s right to defense, and addresses the issue of the possibility of reading the testimony of a witness in the pending court proceedings.

Opracowanie dotyczy problematyki prawa odmowy złożenia zeznań przez świadka z powołaniem się na art. 182 § 3 ustawy z dnia 6 czerwca 1997 r. – Kodeks postępowania karnego1. Celem artykułu jest przybliżenie instytucji odmowy złożenia zeznań przez świadka w sytuacji, gdy jest on oskarżonym w innym toczącym się postępowaniu, kwestii oceny, czy taka odmowa złożenia zeznań przez świadka jest uprawniona i tego, kto dokonuje powyższej oceny. Autor skupia się również na wpływie aktualnego brzmienia art. 182 § 3 k.p.k. na toczące się postępowanie, na zasadę prawa do obrony oskarżonego oraz porusza kwestię możliwości odczytania protokołu zeznań świadka w toczących się postępowaniach przed sądami i organami podatkowymi.
