The article deals with the subject of service of letters omitting a professional attorney authorized in the case due to the lack of possession, and therefore no ePUAP address or address for electronic deliveries is not indicated in the special power of attorney. Such conduct of the tax authority constitutes a violation of the principle of ensuring active participation of the parties in the tax proceedings, as well as being contrary to the principle of the officiality of deliveries. Delivery of correspondence in a tax matter to the address for electronic service is not a mandatory regulation, e.g. due to the existence of other possibilities of delivering letters by the authority, which has been confirmed in the doctrine, and above all in jurisprudence.

W artykule poruszono tematykę doręczania pism z pominięciem profesjonalnego pełnomocnika, umocowanego w sprawie, z uwagi na brak posiadania, a zatem brak wskazania w pełnomocnictwie szczególnym adresu ePUAP1 lub adresu do doręczeń elektronicznych. Takie postępowanie organu podatkowego stanowi naruszenie zasady zapewnienia czynnego udziału stronom w postępowaniu podatkowym, jak również stoi w sprzeczności z zasadą oficjalności doręczeń. Doręczanie korespondencji w sprawie podatkowej na adres do doręczeń elektronicznych nie jest regulacją bezwzględnie obowiązującą m.in. z uwagi na istnienie innych możliwości doręczenia pism przez organ, co potwierdzone zostało w doktrynie, a przede wszystkim w orzecznictwie.
