The article is a summary of the attitude towards the idea of decentralization of law presented by the European Union and state authorities. Contrary to the frequent practice of narrowing the issue of decentralization to the state-municipial authority relationship, this issue should be considered in relation to the attitude of the European Union bodies to the bodies of the Member States. In conclusion, it should be stated that, especially in the last decade, there has been a shift towards the centralization of law-making, both on the basis of the state- municipial authority relations and on the state-EU level. The main difference is that the actions of state authorities are largely effectively inhibited by the courts, while the EU authorities, despite the resistance of individual states, conduct their centralization activities efficiently and faster. It can therefore be concluded that there is currently a trend o f weakening the decentralization of law-making.

Artykuł jest podsumowaniem postawy wobec idei decentralizacji prawa prezentowanej przez Unię Europejską (UE) oraz władze państwowe. W przeciwieństwie bowiem do częstej praktyki zawężania kwestii decentralizacji do stosunku na linii państwo–samorząd zagadnienie to trzeba rozważyć w aspekcie stosunku organów UE do organów państw członkowskich. W konkluzji należy stwierdzić, że szczególnie w ostatniej dekadzie następuje zwrot ku centralizacji stanowienia prawa na gruncie zarówno relacji państwo–samorząd, jak i relacji państwo–UE. Główna różnica polega na tym, że działania władz państwowych są w dużej mierze skutecznie hamowane przez sądy, gdy tymczasem organy unijne, pomimo oporów poszczególnych państw, skutecznie i szybciej prowadzą swoje działania centralizacyjne. Można zatem stwierdzić, że panuje obecnie trend osłabiania decentralizacji stanowienia prawa.
