Zaskarżalność aktów soft law. Podejście Trybunału Sprawiedliwości Unii Europejskiej na tle orzecznictwa wybranych państw członkowskich

Czy akty soft law wydawane przez krajowych regulatorów lub Komisję Europejską mogą podlegać kontroli sądowej? Kwestia ta jest w orzecznictwie przedmiotem rozbieżności. Dominuje tradycyjnie podejście, zgodnie z którym, ze względu na ich niewiążący charakter taka kontrola jest niecelowa lub nieuprawniona. Coraz częściej podkreśla się jednak, że skoro prawo miękkie ogranicza swobodę decyzyjną autora, determinuje zachowanie destynatariuszy, a niekiedy nawet kreuje po ich stronie uzasadnione oczekiwania, to pozostawienie tych aktów poza sferą kontroli sądowej może prowadzić do naruszenia prawa do skutecznego środka prawnego. Mając na uwadze istniejące rozbieżności, celem artykułu jest przedstawienie i porównanie istniejących w Unii Europejskiej oraz wybranych państwach członkowskich mechanizmów kontroli sądowej aktów soft law.
