Artykuł podejmuje próbę oceny głównych założeń postępowania wszczętego przez Bundeskartellamt, niemiecki urząd antymonopolowy, w marcu 2016 r. przeciwko Facebookowi, a tym samym odpowiedzi na pytanie, czy naruszenie prawa ochrony danych osobowych może stanowić nadużycie pozycji dominującej w rozumieniu unijnego prawa konkurencji. W szerszej perspektywie prowadzone przez Bundeskartellamt postępowanie rodzi również ważne pytania dotyczące m.in. relacji między prawem konkurencji a prawem ochrony danych osobowych, zagadnienia uwzględniania kwestii ochrony danych osobowych w prawie konkurencji, a także kompetencji organów antymonopolowych do oceny naruszeń prawa ochrony danych osobowych.
