Safety of CE-Marked Products – Effectiveness of the Market Supervision System

The Supreme Audit Office has carried out an audit of the safety of products with a CE mark (European Compliance). The main objective of the audit was to answer the question whether the marking system provides the consumers with effective protec tion against introducing products that do not meet the EU requirements to the market. NIK also examined whether conditions were created for effective cooperation of the market players in the area, whether administrative procedures were properly conduct ed, and whether education and promotion campaigns were addressed to consumers. The audit comprised the activities of the Office of the Competition and Consumer Protection (Polish: Urząd Ochrony Konkurencji i Konsumentów, UOKiK) since it monitors and coordinates the national systems of market supervision and control, as well as the performance of four market supervision bodies, and it covered the period from 1 January 2016 to 30 June 2018.

Symbol składający się z liter „C” i „E”, pochodzący od słów conformité européenne (zgodność europejska), znajduje się na wielu produktach nieżywnościowych. Oznacza, że spełniają one wymagania Unii Europejskiej. Umieszczenie go jest warunkiem wprowadzenia towarów do obrotu na jednolitym rynku. Weryfikacją spełniania przez produkty określonych norm, w tym prawidłowości oznakowania CE, zajmują się organy nadzoru rynku. W Polsce jest ich 14. Najwyższa Izba Kontroli oceniła, że system znakowania zapewnia konsumentom skuteczną ochronę przed kontaktem z towarami niespełniającymi europejskich wymogów. Niedostateczne finansowanie organów nadzoru, przy wciąż wzrastającej liczbie powierzanych im zadań, może jednak w niedalekiej przyszłości obniżyć ich skuteczność. Problemem jest również to, że konsumenci nie wiedzą co oznacza symbol CE, więc nie poszukują go na produktach.
