EN

One of the duties in the social insurance law is to pay social insurance contributions. The legislator anticipated that in practice, for some reasons, it would not be possible for the payer to make the social insurance contribution. Therefore, the provisions set out certain mechanism that are supposed to facilitate the realization of the above duty. The deepest-reaching of such obligations is writing off the indebtedness for social insurance contributions, which has a special character in the event that there is no total irrecoverability. The solution is auxiliary and may be important in the light of the effects of COVID-19 pandemic on businesses. The aim of this paper is to present selected issues in interpretation as regards the application of the above solution.

Jednym z obowiązków w prawie ubezpieczeń społecznych jest opłacanie składek na ubezpieczenia społeczne. Ustawodawca przewidział, że w praktyce może się zdarzyć, że płatnik z różnych powodów nie będzie mógł uiścić należności składkowych. Wobec tego wprowadził określone mechanizmy, które mają ułatwić realizację tego obowiązku. Najdalej idącym z nich jest umorzenie należności z tytułu składek, które ma szczególny charakter w sytuacji, gdy nie istnieje stan ich całkowitej nieściągalności. To rozwiązanie ma charakter pomocowy, który może być istotny z uwagi na skutki pandemii COVID-19 dla przedsiębiorców. Celem artykułu jest przedstawienie wybranych problemów interpretacyjnych z zakresu stosowania tego rozwiązania.
