This article outlines the nature and features of the regulatory obligation applied in the telecommunications sector in the form of 'functional separation'. This obligation can be imposed on vertically integrated incumbent telecom operators engaging in discriminatory practices towards alternative service providers. The article indicates the main reasons for applying the separation of the wholesale part of the company from the retail unit, shows the main expectations and risks associated with this new tool, in particular its impact on the investment process in telecommunications. The final part of the article is devoted to the admissibility of the application of functional separation under the current Electronic Communications Directives.

Artykuł przedstawia istotę i cechy obowiązku regulacyjnego stosowanego w sektorze telekomunikacyjnym w formie "separacji funkcjonalnej". Ten obowiązek może być nakładany na pionowo zintegrowanych zasiedziałych operatorów telekomunikacyjnych stosujących praktyki dyskryminacyjne w stosunku do alternatywnych dostawców usług. Artykuł wskazuje główne powody zastosowania separacji części hurtowej przedsiębiorstwa od jednostki detalicznej, pokazuje główne oczekiwania i ryzyka związane z tym nowym narzędziem, w szczególności jego wpływ na proces inwestycyjny w telekomunikacji. Końcowa część artykułu jest poświęcona dopuszczalności zastosowania separacji funkcjonalnej na podstawie obecnych dyrektyw o łączności elektronicznej.
