W tym artykule zaprezentowano zagadnienia dotyczące pozycji ustrojowej oraz zadań Urzędu Patentowego Rzeczypospolitej Polskiej w sprawach z zakresu prawa własności przemysłowej w ujęciu historycznym. Urząd Patentowy został utworzony w 1918 r. w krótkim czasie po odzyskaniu przez Polskę niepodległości. Autorka niniejszego artykułu poddaje rozważaniom pozycję, rolę, organizację i strukturę oraz zadania Urzędu Patentowego RP w okresie od 1918 r. do 2018 r. uwzględniając przepisy różnych aktów prawa polskiego normujących te kwestie. Urząd Patentowy RP jest centralnym organem administracji państwowej w sprawach z zakresu własności przemysłowej. W świetle obecnie obowiązującego prawa do kompetencji Urzędu Patentowego RP należy w szczególności orzekanie w sprawach udzielania patentów i dodatkowych praw ochronnych na wynalazki, praw ochronnych na wzory użytkowe oraz znaki towarowe, a także praw z rejestracji wzorów przemysłowych, oznaczeń geograficznych i topografii układów scalonych.

This article presents the issue of the legal position and the responsibilities of the Polish Patent Office in matters of industrial property in the historical perspective. The Patent Office was established in 1918 shortly after Poland regained national sovereignty. The present paper analyses the position, role, responsibilities and organization of the Patent Office from 1918 to 2018 under the basis of legal acts. Under binding law, the Patent Office of the Republic of Poland is a central government authority in matters of industrial property. The Patent Office fulfils its responsibilities concerning industrial property, especially adjudicating in cases of granting patents and supplementary protection rights for inventions, protection rights for utility models and trademarks, and rights in registration of industrial designs, schematic layouts and topographies of integrated circuits.
