In the fifi rst cited judgments, the Supreme Court ruled that the expenses allowance cannot be paid to posted workers and – as a part of an employee’s remuneration – constitutes the basis for social security contributions. In the second judgment the Supreme Court stated that employer has a right to claim for the reimbursement of the outstanding social security contributions payable by the employee, which was paid by the employer as a result of court decision.
