Exercising the freedom of speech and being fired. Analysis of the European Court of Human Rights (ECHR) recent judgments concerning freedom of expression of the employed journalists, and its limitationsThis article deals with the problem of free expression of the representatives of the media. Basing on the record of judgments issued by the ECHR, the author tries to give an answer to the question: to what extent can journalists criticize their bosses, and later claim legality of the actions? A thesis is established in the article: in the light of ECHR jurisdiction, the critical expression of a journalist directed towards his or her principal is protected only in certain circumstances. The factors that have to be taken into consideration are: the nature of the speech, the language used, and the current position of the journalist. More importantly, “duties and responsibilities” oblige both employees of the public and the private broadcasting media.
