The review of case law of the Civil Chamber of the Supreme Court highlights the revolutionary change in the legal position of the subjects-parties to actio pauliana, which is a consequence of the resolution of the Supreme Court of June 16, 2021, III CZP 60/19, that was afforded the force of a legal principle. The resolution of the Supreme Court of May 28, 2021, III CZP 27/20, stating that the right to live in a clean environment is not a personal good, is discussed and positively assessed. The decision of the Supreme Court of March 17, 2021, I CSKP 38/21 on the method of ensuring a child’s return to the country – the place of stay before the violation of the law – is presented. Several rulings concerning the issue of court jurisdiction are also analyzed.

W przeglądzie orzecznictwa Izby Cywilnej Sądu Najwyższego zwrócono uwagę na rewolucyjną zmianę w zakresie pozycji prawnej podmiotów-stron skargi pauliańskiej, która jest konsekwencją uchwały Sądu Najwyższego z 16 czerwca 2021 r., sygn. III CZP 60/19, której nadano moc zasady prawnej. Z aprobatą omówiono uchwałę Sądu Najwyższego z 28 maja 2021 r., III CZP 27/20 stwierdzającą, że prawo do życia w czystym środowisku nie jest dobrem osobistym. Przybliżone zostało także postanowienie SN z 17 marca 2021 r., I CSKP 38/21 dotyczące sposobu zapewnienia dziecku powrotu do państwa będącego miejscem jego pobytu przed naruszeniem prawa. Omówiono też kilka orzeczeń dotyczących kwestii właściwości sądu.
