The Essence of the Civil Process

This article by one of the most eminent civil law scholars in the history of the Polish legal science signals the problem of the legal nature of a civil process; an issue that he had previously addressed, among others, in the 1932 System of the Civil Process (which will be reprinted in “The Library of the Voice of Law” series in a couple of months). The author presents and criticizes three concepts with respect to the legal nature of a civil process and reveals his own viewpoint, whose more detailed treatment can be found in his textbook on civil procedure (to which he refers). The article was originally published in “The Polish Civil Process” (Polski Proces Cywilny), a practice-oriented journal that focuses on an interpretation of the Polish civil process. Minimal textual changes are made through a slight modernization of the spelling.

Ten skromy artykuł jednego z najwybitniejszych procesualistów cywilnych w dziejach polskiej nauki prawa, jest sygnalizacją problemu charakteru prawnego procesu cywilnego, zagadnienia, które wcześniej podejmował m.in. w Systemie procesu cywilnego z 1932 r. Autor przedstawiając trzy koncepcje dotyczące charakteru prawnego procesu cywilnego poddaje je krytyce, przedstawiając własny pogląd – którego rozwinięcie znajduje się w jego podręczniku do prawa procesowego cywilnego (do którego odsyła). Artykuł pierwotnie ukazał się w „Polskim Procesie Cywilnym”, periodyku o charakterze praktycznym, nastawionym na wykładnię polskiego procesu cywilnego. Dokonano minimalnych ingerencji w tekst poprzez nieznaczne uwspółcześnienie ortografii.
